General Terms of Use


These General Terms (hereinafter, “Terms”) aim to regulate access to and general use of the portal www.kudwa.org (hereinafter, the “Website”), as well as the various content and services provided by Asociación Kudwa (hereinafter, “Kudwa”) or third parties through or from the Website.

Kudwa is a non-profit organization that offers courses, workshops, and cultural experiences facilitated by people from conflict-affected or stigmatized countries.


1. Ownership and Definitions

1.1 This portal is managed by Kudwa, with Tax ID No. G-01934702, registered office at Calle De Espronceda, 336, 08027, Barcelona, Spain, and registered as an association in the Registry of the Department of Justice of Generalitat Catalunya under registration number 620067.

1.2 For these Terms, the term “Kudwa” or “We” refers to the Website Owner identified above. The term “You” or “User” refers to anyone accessing, browsing, or engaging with the Website.


2. Use of the Portal

Through the Website, Kudwa provides the necessary access, usage, and information regarding the various products, services, and content offered to Users, either directly by Kudwa or by third parties.

2.1 Using the Website grants You the status of User, which implies full and unconditional acceptance of these Terms. The Owner reserves the right to modify these Terms or any other binding content for the User without prior notice. It is recommended that Users review the Terms each time they visit the Website.

2.2 You agree to use the Website and its offered content and services diligently and correctly, refraining from using it:

  • For activities contrary to the law, morality, and public order, adhering to these Terms.
  • For unlawful purposes, or to harm Kudwa or third parties’ rights or interests, including intellectual or industrial property violations or other applicable legal norms.
  • To perform actions that could disable, overload, or damage systems, equipment, servers, or services of the Website or indirectly accessible through it.

3. Registration and Access

3.1 Any User will have permanent, direct, and free access to the public information contained on the Website. However, Kudwa reserves the right to restrict access to certain information and services to registered users.

3.2 The Website offers contact forms for Users to provide the necessary data for service provision or enrollment in courses, workshops, or activities.

3.3 The requested data must be accurate, truthful, and correct. You are solely responsible for any damages caused to Kudwa or third parties due to failure to fulfill this obligation.

3.4 In accordance with these Terms, the minimum age for User registration is eighteen (18) years. The User guarantees the truthfulness of this declaration and exempts Kudwa from any consequences arising from inaccuracies or falsehoods.


4. Donations, Sales, and Purchases

Kudwa provides all relevant and necessary information for Users to understand the characteristics of donations and purchases before completing a transaction. Please read the specific conditions for each donation or sale.

After selecting a donation and entering your data, payment is made through the BIZUM social payment method linked to the Website. As a data processor under data protection regulations, your personal data may be shared with this payment processor solely for providing the specified service to Kudwa.

The Website provides all necessary steps for completing purchases. At any point, Users can go back to the previous screen to correct or modify their provided information or chosen options.

Amounts for donations are expressed in Euros.
Accepted payment methods are those indicated on the payment platform.


5. Written Confirmation of Information

Upon completing a donation or purchase, the relevant information will be provided via email or another expressly agreed electronic means.

Contractual information is presented in Spanish or English. Kudwa will archive the electronic document formalizing the contract, which will remain accessible to the User at any time.


6. Cancellation and Withdrawal

6.1 For organizational reasons, all activities require a minimum number of participants, which will be indicated in the activity description. If the minimum is not met, Kudwa will notify the User in advance via email and refund the full amount via bank transfer to the account provided.

6.2 Under current distance sales regulations, you have the right to withdraw from the contract within 14 calendar days from its conclusion, except for specific cases outlined in Article 103 of Royal Legislative Decree 1/2007, of November 16.

To withdraw, notify us via email. Refunds will be processed within 14 calendar days from the withdrawal notification date, using a bank transfer to the indicated account. Withdrawal rights are forfeited once the contracted activity is completed, of which you are fully aware and have agreed.

The withdrawal right does not apply to “recreational activities” under Article 103.l of the TRLGDCU.


7. Data Protection

8. Limitation of Liability

8.1 We strive to ensure the accuracy of the Website’s information but cannot guarantee its completeness or accuracy.

8.2 While we endeavor to maintain optimal Website functionality, unforeseen technical issues may occur, resulting in access or navigation interruptions. We assume no responsibility for such issues or related delays, failures, or malfunctions.

8.3 The Website may contain links to third-party sites, provided for convenience. Kudwa is not responsible for the information, functionality, or damages arising from third-party sites.

8.4 While we take all possible measures to prevent viruses and malware, we cannot guarantee their absence on the Website or its hosting server.

8.5 Kudwa reserves the right to permanently suspend the Website’s presence and its services at any time without prior notice. Users will be compensated for any unfinished contracted services.


9. Intellectual and Industrial Property Rights

The intellectual and industrial property rights of the Website’s content—including texts, illustrations, images, guides, corporate marks, and source code—are owned by Kudwa or indicated entities and are protected under Spanish and international law.

Reproduction, distribution, commercialization, or transformation of this Website or its content without prior written authorization from Kudwa is strictly prohibited.


10. Changes to the Terms

10.1 We reserve the right to modify these Terms, with the new conditions applicable from the date of publication. Users are encouraged to review them regularly.

10.2 If any clause is declared null, it will not affect the validity of the remaining clauses.


11. Governing Law and Jurisdiction

These Terms are governed by Spanish law. Any disputes will be resolved by the Courts of Barcelona, except where consumer protection laws designate the User’s local courts.
